Terms and Conditions of Purchase

  1. These Terms and Conditions form the basis of the contract between you and My Team Pixels LLP. .  If you are under the age of 18 years you must have the consent of your parent(s) or guardian(s) to bid for advertising space.
  2. You must have the legal right or authority to bid on behalf of the Company or individual whos name and address will appear in the advert.
  3. You are purchasing an advertising space and your content will be displayed for one month. Mechanisms are in place to allow you to bid for multiple adverts and care should be taken to ensure that you are aware of the total that you are committing when you bid. We have taken reasonable measures to stop you from bidding a value above the number of credits available to you but can not be held responsible for the actual amount of bids accepted by the system made by you.
  4. The content you choose to display on the space must comply with the following requirements:

    1. Text must be in the English language;
    2. You must have the legal right to use the Image or Text you provide for your space and you confirm that you have the authority to use, reproduce, publish and store any Image and/or Text you submit to us and that such authority extends to our use, reproduction, publication and storage of the said Image or Text;
    3. Images and/or Text shall not be of an obscene, offensive, adult, unlawful, defamatory and/or inappropriate nature (as determined and is our sole discretion) when considered in both isolation and in view of the other Images and/or Text. Should you attempt to place any material that is considered by us to be inappropriate then your content will be removed and you will not receive a refund; we will also take legal action against you for breach of contract.

  5. All bids are conducted in multiples of £1 (1 token). When you place a bid, you are committing a number of tokens to that advertising space if your bid is successful.
  6. Payment for tokens are in multiples of £10 + VAT at the prevailing rate.  Each token is valued at £1 + VAT, therefore multiples of 10 tokens are purchased.
  7. No refunds are provided; tokens remain in your account until you have a successful bid; at this time the required number of tokens are deducted from your account. The price that you pay at the time you buy your tokens is final and cannot be refunded.
  8. You can request that your content is removed at any time but the space will become publicly available again and you will not receive a refund.
  9. We will not normally change or remove your content (except in accordance with these Terms and Conditions), but  reserve the right to do so under exceptional circumstances such as if we receive a court order, notification that the content is of an obscene, offensive, adult, unlawful, defamatory and/or inappropriate nature, lawsuit or public outcry. When such a removal happens, the space will become publicly available and you will not receive a refund, we will also provide your personal details (if requested) to the complaining party in accordance with Section 35 of the Data Protection Act 1998.
  10. Occasionally the site may be taken off-line for reasons such as, site maintenance, switching servers and /or upgrading but we aim to keep the downtime of the site to a minimum. No refunds will be given for site down time.
  11. We will not transfer any personal data you provide to us other than in accordance with the provisions of these Terms and Conditions and the Data Protection Act 1998.  You confirm that in providing your personal data and content to us you are acting in accordance with the provisions of the Data Protection Act 1998.
  12. When you purchase space, you acknowledge and accept that you do not own or obtain any right whatsoever (other than as granted by these Terms and Conditions) to any part of the space in which you are advertising or the website of which it forms part. 
  13. Neither of us shall be liable to the other for any default due to any act of God, war, strike, lock-out, industrial action, fire, flood, drought, tempest or other event beyond the reasonable control of that party.
  14. You shall indemnify us against any and all costs, claims, proceedings, losses, liabilities, damages (including reasonable costs), charges and expenses of whatever nature arising from any breach by you or any person acting on your behalf of these Terms and Conditions.
  15. These Terms and Conditions and any contract between us shall be governed by and be construed in accordance with the Laws of England and we agree to submit to the non-exclusive jurisdiction of the English Courts.
